These Terms of Use (the "Terms") govern your access to and use of the EndureMint website, platform, content, communications, and related non-clinical services made available by ENDUREMINT LLC, a California limited liability company, with a business address at 1412 Raeburn Way, Roseville, CA 95747 ("EndureMint," "we," "us," or "our"). By accessing or using the website or creating an account, you agree to be bound by these Terms. If you do not agree, do not use the website or services.

These Terms apply only to EndureMint's website and non-clinical business operations. EndureMint does not practice medicine, provide medical advice, prescribe medication, compound medication, or operate a pharmacy. Telehealth services are provided, where available, by independent licensed clinicians or affiliated medical groups, and prescriptions are fulfilled by licensed pharmacies, including licensed compounding pharmacies, each of which operates under its own legal terms, notices, and professional obligations.

EndureMint operates as a marketing and administrative services organization. Our role is to provide a consumer-facing website, facilitate account creation and onboarding, collect and transmit information as needed to support platform operations, process or coordinate subscription and billing functions, provide customer support for non-clinical matters, and help connect eligible users with independent third-party clinical and pharmacy partners.

EndureMint's services do not include diagnosis, treatment, medical judgment, prescription decision-making, pharmacy services, emergency response, or any professional medical or pharmaceutical service. Any clinical decision is made solely by an independent licensed clinician, and any medication fulfillment is handled solely by the dispensing pharmacy.

You may use the website only if you are legally able to enter into a binding agreement and are at least the age of majority in your state or territory of residence. The platform is intended only for users located in jurisdictions where the services are offered. You may not use the website on behalf of another person unless legally authorized to do so and accepted by the relevant clinical or pharmacy partner where applicable.

By using the website, you represent and warrant that the information you provide is truthful, current, complete, and accurate, and that you will promptly update any information that changes.

To access certain features, you may be required to create an account and provide identifying, billing, and other information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must notify EndureMint promptly at [email protected] if you believe your account has been accessed without authorization.

We may suspend or terminate access to your account if we believe you have violated these Terms, provided false or misleading information, engaged in fraudulent or abusive conduct, or used the website in a manner that may create legal, operational, or security risk.

If you use the website to seek telehealth-related services, your interactions with any clinician, medical group, or pharmacy are between you and that third party. Those third parties may require you to agree to separate consents, privacy notices, financial terms, or other agreements. EndureMint is not a party to the practice of medicine or the dispensing of medication and is not responsible for independent professional decisions made by clinicians or pharmacies.

Use of the EndureMint platform does not guarantee that you will be matched with a clinician, that a clinician will determine any treatment is appropriate, that a prescription will be issued, or that a pharmacy will fulfill any prescription.

Certain EndureMint offerings are provided on a monthly subscription basis. By enrolling in a subscription plan, you authorize EndureMint and its payment processors to charge your selected payment method for the recurring subscription amount, applicable taxes, and any other clearly disclosed charges associated with your plan.

Your subscription will renew automatically on a recurring basis unless and until you cancel in accordance with these Terms. Renewal timing may be based on your original enrollment date, your next billing cycle, or another schedule disclosed at checkout or in your account. You are responsible for maintaining a valid payment method and for ensuring billing information remains current.

You may cancel your subscription at any time through your account, if that functionality is available, or by contacting [email protected]. To avoid the next recurring charge, cancellation must be received before your next billing date. If cancellation is received after a charge has been processed, the cancellation may apply to the following billing cycle unless otherwise required by law or expressly stated in a separate policy.

EndureMint may terminate or suspend your access to all or part of the website at any time, with or without notice, if necessary to protect the platform, comply with law, prevent suspected misuse, or respond to actions that violate these Terms.

Refund eligibility is governed by our applicable refund policy and any requirements imposed by law. Because prescription products may be customized and compounded for an individual patient, they are generally not returnable and not refundable once processed, prepared, or dispensed, except in the event of a verified error, damage, or other circumstance where a refund is required by law or approved in our discretion.

You agree not to use the website in any unlawful, fraudulent, abusive, defamatory, harassing, infringing, or misleading manner. You may not attempt to interfere with the operation or security of the website, gain unauthorized access to any account or system, impersonate another person, scrape or harvest data without permission, or use the website in a way that could damage EndureMint, its users, or its partners.

The website and all content, design elements, branding, software, text, graphics, images, audio, video, compilations, and other materials made available by EndureMint are owned by or licensed to EndureMint and are protected by intellectual property and other applicable laws. Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to access and use the website for your personal, non-commercial use.

By providing your email address and using the website, you consent to receive electronic communications from EndureMint relating to your account, transactions, support matters, subscriptions, and updates to the website or applicable policies.

THE WEBSITE AND ALL CONTENT AND NON-CLINICAL SERVICES PROVIDED BY ENDUREMINT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, TO THE MAXIMUM EXTENT PERMITTED BY LAW. ENDUREMINT DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

EndureMint is not a medical provider or pharmacy. Nothing on the website constitutes medical advice, diagnosis, treatment, or a substitute for consultation with a qualified healthcare professional.

To the fullest extent permitted by law, ENDUREMINT LLC, and its officers, managers, members, employees, contractors, licensors, service providers, and affiliates, will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunity, or other intangible losses, arising out of or relating to your use of or inability to use the website or any third-party clinical or pharmacy service, even if advised of the possibility of such damages.

To the fullest extent permitted by law, the total aggregate liability of EndureMint for any claim arising out of or related to these Terms or the website will not exceed the greater of (a) the amount you paid to EndureMint during the three months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

You agree to defend, indemnify, and hold harmless EndureMint and its affiliates, officers, managers, members, employees, contractors, licensors, service providers, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and attorneys' fees arising out of or related to your violation of these Terms, your misuse of the website, your violation of law, or your infringement of any third-party rights.

The website may contain links to or integrations with third-party websites, tools, payment processors, analytics providers, clinical partners, or pharmacies. EndureMint does not control and is not responsible for third-party content, services, availability, privacy practices, policies, or business operations.

If a dispute, claim, or controversy arises out of or relates to these Terms or your use of the website, the parties agree to first attempt to resolve the matter informally. You must send a written notice describing the dispute to [email protected] and to ENDUREMINT LLC, 1412 Raeburn Way, Roseville, CA 95747. The parties will use reasonable efforts to resolve the matter within thirty (30) days.

If the dispute is not resolved informally, then, to the extent permitted by law, the dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under its applicable consumer rules. You and EndureMint each waive any right to participate in a class action or class arbitration to the fullest extent permitted by law.

These Terms and any dispute arising out of or relating to them or the website will be governed by the laws of the State of California, without regard to conflict of laws principles, except to the extent superseded by applicable federal law.

EndureMint may modify, suspend, discontinue, or update the website, subscriptions, features, content, pricing, or these Terms at any time. If we make material changes to these Terms, we will post the updated version on the website and update the Effective Date above. Your continued use of the website after updated Terms become effective constitutes your acceptance of the revised Terms.

These Terms constitute the entire agreement between you and EndureMint regarding the website and supersede prior or contemporaneous understandings relating to that subject matter. If any provision of these Terms is held unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

EndureMint's failure to enforce any provision of these Terms is not a waiver of that provision or any other provision. You may not assign or transfer your rights or obligations under these Terms without EndureMint's prior written consent.
